To Mr. Desrochers Ste-Anne

Quebec February, 17 1845

Sir,

I am returning the old contracts of your parish that I wanted to see concerning the foundation of the great mass celebrated in the church of Ste-Anne in honour of St-Etienne that the Vicar was obliged to conduct for his people.- The content of the contract had been approved by the bishop of that time.

I am wondering why these contracts were not found during my intensive search that I did in Ste-Anne as I did elsewhere, so to have on record, a detail of all contracts of all parishes .- I found the foundation of two great mass to perpetuity, for the gift made by the habitants of St-Joachim, that must be celebrated inta Octavam Conceptionis.

(January 15, 1720); plus the foundation of 18 mass for your Orchard in the testament of Monsieur Chabot (February, 13 1728). But none of the Vicar of Ste-Anne told me about the foundation of St-Etienne.

They must find a way to solve the problem of this antique foundation. - This foundation was accepted after receiving a piece of land, that the parish was no more the owner, you must search among the elder of your parish to find out if the land in question was alienated by the parish, and if, by being alienated, it was freed of all charges it had received.

The land on which the church now stands is actually one acre and 73 poles in surface given by Mr. Cadet, on August 22, 1766.- A few feet of land was given by Mr. Bonaventure and Joseph Lessard on October, 24 1768 (Crepin, notary). The new title is from the same notary on December, 22 1769.

Here is a few facts that will have you make new discoveries. If the foundation does not rely on any exiting founds, the parish would find it self charged without any compensation.- I do not know if there as been any rates related to this great mass.

I will be ready to solved this concern, when you will have given me the information necessary.

Sir

After having read the contracts  that where given by Mr Beaumont, Mgr. the Coadjutor and myself are in favour that the representative Jamineau must pay the Vicar of Ste-Anne the annual rent of 11 pounds  and the Vicar of Ste-Anne as the right to take his provision of wood on the land in question.

 

Regarding the mass on St-Etienne day, that would be celebrated for the Lessart foundation, we also feel that this mass must be reduced to a simple mass on that day, fallowing the terms of the first contract of donation; the Burial in the church in favour of the oldest of his  descendant Lessard in direct linage, if they exist, all burial fees must be paid by the parents of the decease . The said oldest descendant Lessart in direct linage seems to have de right to receive the holly bread after the churchwarden; but for the reception of the candle and the palm after the churchwarden, it seems that in the contract the said Lessart had reserved this honour for him self. It must be why this custom as stop since a long time.- This is what will be settle in an official document.

I have in my hands the contracts that Mr Beaumont brought me. I will send it back on a suitable occasion.

Decision of the assembly of churchwardens

 

Ordonnance

December 18, 1845, the churchwardens new and old where convoke, according to  the normal usage, after the mass, consented that the mass of foundation, the day of St-Etienne, for the family Lessard, would the sang for free. Present François Giguere, Bonaventure Lessart, Augustin Mercier, Jean Caron, Jean Guimond and Leon Mercier who declared not to be able to sign.

It was understood by a certain deed passed in front of Master Audouart Notary on March 8, 1658, Your Grace of Laval de Montmorency, Bishop of Petree, Vicar Apostolic of New France, had permitted a Mass, Vespers and the Blessing of the day of Saint Etienne, in the church of Sainte-Anne of Petit Cap on the cost of Beaupre, for the family of Sir Etienne Lessart, habitant of the said parish and donator of the land to the parish in virtue of the same act;

And since the Saint Etienne holiday was a day off, by amendment of November 25, 1844, we have declared that all devotion days would be abolished;

In consequence we have rule and are settling as fallow :

It will be sang, in the church of Sainte Anne of Petit Cap, on the cost of Beaupre, a Mass on the Saint Etienne holiday, when it does not fall on a Sunday , and if it is celebrated a Sunday, the first suitable day to come:

 The Vicar and the vestry of the said parish will not receive any fees for the said great Mass, but in return the Vicar will continue to have the right to receive from the actual owner and of future owners of the same land the annual rent of eleven pounds and to take his provision of wood on the said land in virtue of the  act of sale dated December 27,1666, passed in front of Master Duquet, notary between the said Lord, Bishop of Petree and the Sir Urbain Jamineau; this act was deposited in the Archives of the vestry of the said parish.

Will be the present ruling communicated to the churchwardens of the said parish convene in an assembly.
